DECISION IN FAVOR OF RAILROAD COMPANIES

Only Virginian Charges Too Much for Dumping and Trimming Coal at Norfolk
Washington, Feb. 22. (Special)--The interstate commerce commission has rendered a decision in the complaint of the New England Coal and Coke Co. against the Norfolk and Western Railroad [sic] Co., and other roads carrying West Virginia coal to seaboard. The decision is in favor of the railroad companies in the main, but in the case of the Virginian Railroad [sic] the finding is against it. The complaint of the coal and coke company filed on March 27, 1911, was that the charge of the railroad companies for dumping coal into the vessels for shipment to New England and for trimming the coal in the vessels was too high. A rate of three cents a ton has been charged for trimming and four and a half cents for dumping and trimming. It was alleged by the New England Coal and Coke Company that its vessels are self trimming, requiring little labor to load the coal properly and that a charge of half a cent a ton would be sufficient for the work required in their type of vessels. In the report of the commission there is an elaborate treatise on the loading of vessels and the different methods of doing so resulting in the finding that three cents a ton for trimming and four and a half cents for dumping is not unreasonable. The commission further finds that the charge of four and a half cents made by the Virginian Railway Company for trimming alone is too high and it is required to establish a rate not to exceed three cents a ton. Reparation is ordered to be made by the Virginian Railway Co. in the sum of about $500 for the excessive charges in the past. The complaint as to the Norfolk and Western Railway Co., the Chesapeake and Ohio Co. and the Western Maryland Railway Co. is dismissed.
