Southern Indicted for Having Bad Roadbed

Asheville, N. C., Sept 5 -- Two true bills have been found against the Southern railway by the superior court grand jury of Transylvania county on account of the condition of the Southern's roadbed, which it is alleged, is in a highly dangerous condition. Solicitor Mark Brown, of Asheville, instructed the grand jury in Brevard to bring presentments against the Southern. Accidents have been of frequent occurrence of late on the Southern from Hendersonville, N. C., to Lake Toxaway, N. C., and a short time ago a passenger train, which had 300 [blurred; best interpretation] passengers on board was partly overturned on a steep mountain grade.

[So far I haven't come across anything in the Bluefield newspaper disparaging roadbed conditions on the N&W.]
