ASH VS. STREET RAILWAY

Damage Suit Tried in Hustings Yesterday - Hung Jury

All of yesterday was consumed in hustings court by the damage suit
of L. S. Ash against the Roanoke Street Railway and Electric Company.
Sometime last February the plaintiff boarded one of the company's
cars to pay a visit to his brother who lives in northwest Roanoke. He
indicated to the conductor that he wanted to alight at Second avenue
and Park, but the car did not stop at that place, but went on some
further. The place was dark and the track and ground were covered
with snow and ice. When Mr. Ash got off, he fell and claims to have
received injuries form the same. He is suing for $2,000.
When the arguments of counsel closed at 5:30, the jury retired and
after being out thirty minutes they returned and announced that they
were unable to get together on a verdict. The judge requested that
thy return to court Monday morning and see if at that time they could
get together on a decision.
